This Disclaimer explains the use of information and technical results provided through Emlyzer and its website, operated by solveEM e.U., Holzhäuser 8, 4702 Wallern, Austria ("we", "us"). It complements our EULA and Terms and Conditions.

Calculations and Technical Use

Calculations, visualisations and other outputs depend on the accuracy and completeness of input data, model assumptions, selected calculation methods and settings. Incorrect inputs, unsuitable assumptions, numerical limitations or settings that do not match the intended situation can produce misleading results.

Before using results for technical decisions, check inputs, units, assumptions, settings and output plausibility. Depending on the intended use, verify results with independent calculations, measurements, relevant standards or review by a qualified person. An output alone does not certify regulatory compliance or establish design safety or suitability.

Examples and website explanations provide guidance and do not replace assessment of your actual application. These statements do not remove agreed product obligations or statutory remedies for defective software.

Warranty and Liability

Mandatory statutory rights concerning conformity, warranty, necessary updates, repair, replacement, price reduction, termination and refunds remain unaffected. We give no additional voluntary warranty that Emlyzer is error-free, uninterrupted or suitable for a particular purpose beyond the agreed product specifications and express commitments made at purchase.

We exclude liability for damage caused by slight negligence, except for personal injury and the other exceptions below. This includes loss of profit, loss of data, business interruption and indirect or consequential loss only where that exclusion is legally permitted. It does not excuse performance of our contractual obligations.

Nothing in this document excludes or limits liability for death or personal injury; intent or gross negligence by us or persons for whom we are responsible; fraud; mandatory product liability; claims under mandatory data protection law; or any other liability that cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected. Where applicable law prohibits an exclusion, statutory rules apply. No fixed monetary liability cap applies.

The same provisions apply in our EULA and Terms and Conditions. This Disclaimer introduces no additional waiver and does not override more favourable contractual commitments.
